1. About these terms
SmartPOS is provided by AS Apps (Arlind Sela, North Macedonia). A business that buys SmartPOS (the "venue") may also have a separate agreement with us about price, installation and support. If that agreement conflicts with these terms, the agreement wins.
2. Access and accounts
- The mobile app is for staff and owners of venues that use SmartPOS. Access is given by the venue's administrator (venue address, access key and personal PIN).
- Keep your PIN and access keys private. You are responsible for actions made with your PIN.
- The venue can change your role, permissions or remove your access at any time.
3. License
We give you a personal, non-exclusive, non-transferable license to use the app to work with your venue's SmartPOS system. You may not copy, modify, resell, reverse engineer or try to bypass the security of the software, except where the law allows it.
4. Acceptable use
- Use SmartPOS only for lawful business purposes.
- Do not try to access venues, data or functions you have not been given access to.
- Do not overload, attack or interfere with the venue's server or the app.
5. Venue responsibilities
The venue is responsible for the correctness of its prices, taxes and records, for issuing fiscal receipts as required by law, for keeping its server PC and backups safe, and for the personal data it records about staff and clients (see the Privacy Policy). SmartPOS is a tool that helps with these tasks; it does not replace the venue's accountant or legal obligations.
6. AI features
AI features (such as "Ask your business" and invoice reading) give suggestions based on the venue's data. Always check AI results, such as stock entries read from an invoice, before confirming them. Where AI is used, the venue chooses the AI provider and API key.
7. Availability and updates
We work to keep SmartPOS reliable, but we cannot guarantee that it will always be available or free of errors, for example when the venue's network, server PC or internet connection is down. We release updates to fix problems and add features. Some features may require the latest app version.
8. Intellectual property
SmartPOS, AS Apps, their logos, design and code belong to AS Apps. The venue's business data belongs to the venue.
9. Liability
To the extent permitted by law, the software is provided "as is", and AS Apps is not liable for indirect or consequential losses such as lost profit or lost data. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence.
10. Ending use
You can stop using the app at any time by signing out and uninstalling it. We may suspend access if these terms are seriously breached or to protect the security of a venue's system. See Delete your data for how to remove your data.
11. Governing law
These terms are governed by the laws of the Republic of North Macedonia. Consumers keep any mandatory protections of the country where they live.
12. App Store & Google Play
If you downloaded the app from the Apple App Store, these terms are between you and AS Apps, not Apple. Apple is not responsible for the app or its support, and Apple's standard Licensed Application End User License Agreement also applies where these terms do not cover a topic. Google Play's terms apply to downloads from Google Play.
